New legal obligation for CPOs with charging stations ≥ 43 kW
On June 26th, 2024, Royal Decree-Law 4/2024 was published, introducing a key modification to the Electricity Sector Law (Law 24/2013). This regulation establishes a new obligation for charge point operators (CPOs) with publicly accessible infrastructures and power capacities equal to or greater than 43 kW: to submit dynamic information to the new Management and Visualization System (SGV) managed by Red Eléctrica de España (REE).
From now on, these operators must provide the following data in real time:
- The public retail price of electricity or the charging service.
- The availability of the charging point.
This requirement addresses the need to improve the transparency of the electricity system and facilitate information for end-users, aligning with the Government’s sustainable mobility objectives.
Which regulations govern this?
The new functions assigned to REE as the Responsible Entity for the SGV are backed by the following regulatory framework:
- Order TED/445/2023, of April 28th.
- Law 7/2021, on climate change and energy transition.
- Royal Decree 184/2022, regulating the energy charging service.
- Law 37/2007, on the reuse of public sector information.
- Resolution of the State Secretariat for Energy (approved on November 23rd, 2024), detailing the technical instructions of the SGV.
What are the implications for operators?
The integration into the SGV is mandatory for all publicly accessible charging stations with power capacity equal to or greater than 43 kW, and voluntary for those with lower capacity. To do this, CPOs must:
- Register on the REE Customer Services Portal
- Request integration into the SGV, following the published technical instructions.
- Ensure the automatic transmission of dynamic data in accordance with Annex III of Order TED/445/2023.
